Law Firms Keep Squeezing Associates

Law firms are finally starting to recover from the recession, but they aren't taking their young lawyers along for the ride.

Even as profits return, cautious partners with one eye on damaged balance sheets and the other on stingy clients plan to hang onto the lean silhouettes they acquired during the downturn.

That means little relief for young associates—who took on hefty law-school loans, only to run into layoffs and stagnant pay in the years since 2008—and fewer chances for new law-school graduates to get in on the ground floor. And the elusive brass ring of partnership has grown more remote.

"What happens if Greece falls apart again?" says Greg Nitzkowski, managing partner at Paul Hastings LLP, an international firm that has reduced entry-level hires by about a third since 2008. "We just think it's prudent to plan as if this coming year is going to be a relatively flat year.…We're not planning for a big upsurge in demand."

Conditions at law firms have stabilized since 2009, when the legal industry shed 41,900 positions, according to the Labor Department. Cuts were more moderate last year, with some 2,700 positions eliminated, and recruiters report more opportunities for experienced midlevel associates.

But many elite firms have shrunk their ranks of entry-level lawyers by as much as half from 2008, when market turmoil was at its peak. Salaries and bonuses for those associates have remained generally flat. Meanwhile, a degree at a top law school can cost $100,000 or more.

Associates at prominent law firms say some of their peers hired during the boom years are happy just to have jobs at all. "The world has changed," says a senior associate at a top firm.

The complaint alleges that, during the Class Period, defendants issued materially false and misleading statements regarding the Company’s business and prospects. Specifically, defendants misrepresented and/or failed to disclose the following adverse facts: (i) that the Company was experiencing so-called “squeeze” events in Alabama and lower coal transportation rates in Canada that significantly reduced Walter’s coal production; (ii) that the Company’s commitment to ship more than 700,000 tons of coal in the second quarter at first quarter sales prices would result in a material adverse effect on Walter’s average sales prices and operating results during the second quarter; (iii) that Walter was experiencing a significant decline in its margins and profitability; and (iv) that, based on the foregoing, defendants lacked a reasonable basis for their positive statements about the Company and its business prospects during the Class Period.

On August 3, 2011, Walter issued a press release announcing its operating results for its 2011 fiscal second quarter, the period ended June 30, 2011. For the quarter, the Company announced net income of $107.4 million, or $1.71 per diluted common share, significantly less than Wall Street estimates. Then, On September 21, 2011, Walter issued a press release announcing its attempt to “enhance” its historical statistical disclosure and its revisions to its 2011 second half sales expectations. In response to this announcement, the price of Walter common stock declined from $75.00 per share on September 20, 2011 to $66.25 on September 21, 2011, on extremely heavy trading volume.

At our law firm's most recent staff meeting, I was assigned the task of finding a law firm website design company for creation of a website for our firm. I've had previous experience researching companies online and I thought it would be simple to turn to Google and find the right website design company in a flash. As simple as it sounded, the task was not as easy as I thought it would be. In fact, I felt defeated after a few hours searching online.

While conducting an extensive research on law firm website design companies, it was brought to my attention that all website vendors will try to claim the title of being the "best". What exactly does that mean? I searched, I called, and I spoke with a wide variety of the "best" website design companies, only to have them set me back one step. For one, I was extremely confused when I asked one of the more important questions: PRICING. Many companies provided me a quote varying in range with monthly service fees and charges for unnecessary features. In my opinion, a website design should be a one time contract work. This means you own the website and the website development is paid for at once, not over a year or longer.

I found some law firm website design companies willing to charge you a whopping $10,000 in addition to a one year website contract that required a monthly fee. This fee covered their client's access to using their website's unnecessary bells and whistles. Cool? Sure! Well, that's if your boss doesn't have a problem with burning through your firm's budget. Some other law firm website design companies I ran into offered a "cheap" and more budget-friendly price around a few hundred dollars to develop a website. The only problem was that, well, we get what we pay for-- a cheap looking website. Their portfolio showed their client's website and immediately turned me away. Their design and development skills were far from something worth showcasing and reflected a mediocre and unprofessional look.To my disappointment, finding a good and reputable law firm website design company proved to be more than a few clicks away. I knew it would take a lot more time to find something that would appease my boss' standards. Initially, I was too shy to ask for a longer time period to finish this seemingly easy task. But after two weeks, I had sufficient time (just barely!) to gather all the information I needed to determine what features a good law firm website design company should possess.To save some of you in the same position a little time and grief, I would like to share some important components I felt were necessary in finding a good law firm website design agency.

The Good:

- Have a user-friendly and reliable content management system (CMS) to update the website.
- Be familiar with all the latest Search Engine Optimization techniques in order to gain maximum potential for your website to rank at the top of search results.
- Offer a robust web-hosting and maintenance plan. Law firms are busy as it is and having the website design company not only host, but maintain the website is an absolute plus.
- Not charge for any unnecessary bells and whistles.
- Have reliable testimonials that can prove real client satisfaction.
- Provide good customer support service. Exceptional customer service should be all about the customer satisfaction. They should be able to answer all inquiries in a swift and thorough manner and reduce the technical website design jargon to a level anyone could understand.
- Charge you by project base (a straight forward, one time website design cost instead of monthly payments).

I know the pressing question on every one's mind is, well, how do you know? Spending extra money doesn't necessarily mean better. There were quite a few law firm website design agencies in this category, asking for a pricier sum and delivering decent products, however; there are reasonably priced website design companies who deliver even better websites. Of course, my opinion is mine. But if you want your investment in a website design company to be worthwhile, just heed my advice. Remember, I had to ask for an extension on my task in order to really understand what separates the good from the bad.

The Bad:

Just like there is yin to yang, black to white, and hot to cold, there unfortunately has to be the good law firm website design companies to the bad law firm website design companies. I don't know about you, but doing the research alone to complete my task took a lot of time. You know how that saying goes, "Time is money and money is time"? Well sure, this is one of the big differences from the good website design companies versus the bad website design companies.The bad law firm website design company:- Includes a contract that obligates you to pay an overpriced rate for a law firm website design or a technology license fee on a monthly basis. I personally don't like contracts. I mean, it binds me and limits my flexibility if I'm unhappy with a company's services. This can pose a problem later if you decide your business and law firm needs a change and want to part ways.

- Has many over-priced service fees. They will milk you with all kinds of unnecessary website features that you weren’t even aware of.
- Is able to deliver a decent website design layout but seem to get lost in their cookie cutter design elements. Every client's website may look clean and professional but lacks the uniqueness and branding of why clients should choose THEIR law firm instead of the firm across the street (whose website looks and repeats the exact same information as yours by the way).
- Shows poor SEO track records that give you a slim to none chance to rank at the highest position on top search engines like Google, Yahoo!, AOL and Bing.

Let's get down to the nitty-gritty and do a little math here:For the purposes of this article, we will be purchasing a website for a small firm with 20 attorneys and 2 offices. And if we break down the website design costs from the good and the bad, you can immediately see the major downfalls of the bad.The Good Law Firm Web Design Company: 1-time website design cost averaging $5,000 - from a reputable GOOD law firm website design company. And you get to own it!

The Bad Law Firm Web Design Company: An annual 1-year license cost averaging well over $6,000 that you must continuously keep paying on a year to year basis. If you do the math here, you can say you're wasting an incredible amount of money that can go to other marketing resources to help further your business. Since your website will end up costing you too much, you will have a limited budget for marketing campaigns through organic SEM or PPC.With that said, generally "bad" website design companies are hard to distinguish because they will deliver a decent product but in turn try to take advantage of prices. In this case, everyone should be cautious and careful. This especially may be a slippery slope for new start-up firms who believe that only the best law firm websites will be delivered by paying a huge amount of money. The Bad more than likely will result in a poor return on investment. To prevent getting stuck with the bad law firm website design company there is a golden rule to remember: just because it's out there, doesn't mean it's the best! The Ugly

And (finally!) we get to talk about the law firm website design company that has every aspect of just plain ugly. No matter how much you end up paying for it - or even if it's completely free - don't be a victim of building a law firm website that will make your firm look "unsophisticated", "inexperienced", and "out-dated". Yes, these words usually do a good job of scaring off potential clients who come to visit your website. Many potential clients will walk away and go to other law firms that they see as better competitors. However, it's surprising to see how many law firms still go along with ugly law firm website design companies. Some think having any website would benefit their business, but little do they know... it is doing quite the opposite.Business is all about status and if you have a law firm website that costs your business because it's ugly?...well, that is literally just UGLY.

Most people are always on the go, have minimal time to fit everything in their schedule and are not patient. Web users form first impressions of web pages in a matter of 50 milliseconds, according to researchers. Human beings are very visual creatures, so in a blink of an eye, we will make an instantaneous judgment of a websites "visual appeal". We like things that are aesthetically appealing and through the "halo effect", first impressions can color subsequent judgments of perceived credibility, usability, and professionalism. Ultimately these factors influence a web user's purchasing decisions and whether we want to use your law firm to represent our needs.First impressions count immensely in the legal industry and should be considered in law firm website design. If the website design is difficult to read, intrusive, or poorly signposted, your visitors will go elsewhere. We've all experienced trying to navigate through a less-than-friendly website and reading a screen that strains your eyes versus printed paper. A clean, professional look is a MUST for law firm websites - don't get sucked into the ugly website category that will cost your business (even if it's FREE!), I like to view ugly websites comparable to that of a parasite, where the website design company benefits at the expense of your law firm and business. In this case, your law firm is being harmed. Some elements make a law firm website design good, some make them bad, and some make them ugly.

The great line between these elements can determine whether your website is:

- Interesting or boring
- A good design or bad design
- Has good color or bad color
- Has a good layout or bad layout
- Is imaginative or unimaginative

This is a tragic story of Government and Corporate Irresponsibility that resulted in the clearly preventable deaths of three innocent Logan, Utah residents, Jackie Leavey, Age 43, and her 2 children, Victor Age 13, and Abbey Age 12.

Everyone in authority at the city, the State University, the Department of Transportation, and the local canal company knew there was a serious problem with the Logan canal, in Logan, Utah.

In the days preceding the mudslide, officials had visited the site and had seen the water squirting 10 feet high into the air because it was under so much pressure in the canal.

They all knew the danger of a mudslide in that particular area. It had happened before-they knew it would happen again, soon. Folks in the affected neighborhood kept calling the city. Call after call and nobody cared.

No one took action, no one did a thing. Then the unthinkable occurred. A mudslide of tremendous proportions dropped on a home, killing a mother and her two children.

It took days to sift through the mud, trying to recover their bodies. Folks were somber and reflective. But then the finger pointing began. Each department blamed another for not taking action. Only it was too late, too late to save the mother and her children.

Split over union law reaches Wis. court race

The slim margin between Wisconsin Supreme Court Justice David Prosser and his challenger, JoAnne Kloppenburg, has grown slightly in favor of the incumbent as late election numbers are tallied.

But the race that reflected Wisconsin's fight over union rights is still too close to call Wednesday morning. With 99 percent of precincts reporting, conservative-leaning Prosser is leading Kloppenburg by 835 votes. Final, official results could vary and a recount appears likely.

The race highlights the divide in the state over Republican Gov. Scott Walker's collective bargaining law, which would strip public workers of nearly all their union rights. The issue, which could ultimately be decided by the state Supreme Court, has propelled the relatively unknown Kloppenburg into prominence and heightened voter interest in the election.

A class action lawsuit is alleging that Fixodent denture cream may have caused serious problems.

ABC News reported that lawyers for two former denture cream users are accusing Proctor & Gamble of manufacturing a product that made their clients extremely ill.

Mark Jacoby, a 41-year-old construction worker who wore dentures for 20 years, told ABC News that he believes his debilitating neurological illness is due to the high zinc content in his Fixodent.

"I started getting tingling in my fingertips. And then it started happening in my toes," he told ABC News' 20/20 anchor Chris Cuomo, who is the Chief of the Law & Justice Unit. "I started getting weaker and, you know, I couldn't walk right, off balance and I'm at this point now."

He said his doctors searched for years for the cause of his debilitating neurological illness that robbed him of his independence.

Court rejects bid to remove judge in Pitino case

A federal appeals court has rejected a bid to remove the judge overseeing the case of a woman convicted of trying to extort millions from University of Louisville coach Rick Pitino.

The two-page decision issued Monday by the U.S. 6th Circuit Court of Appeals also turned down a request by Karen Cunagin Sypher to delay her sentencing, which is set for Feb. 18.

Sypher was convicted in August of extortion, lying to the FBI and retaliation against a witness. Prosecutors said she sought millions in cash, cars and a house from Pitino to stay quiet about their one-night stand at a Louisville restaurant in 2003.

Her attorney, David Nolan, has filed multiple motions alleging a wide-ranging conspiracy involving Pitino, U.S. District Judge Charles R. Simpson III and multiple people involved in the case. Prosecutors have called Sypher's claims meritless.

Voters to narrow Supreme Court candidate field

Wisconsin has focused on the Green Bay Packers and Gov. Scott Walker for the last month, but another fight with perhaps just as much impact on the state is about to take center stage -- the state Supreme Court primary.

Justice David Prosser faces three challengers. Voters on Tuesday will choose two survivors who will face off in April's general election. The winner gets a 10-year term on the court.

The primary has played out in the background as the Packers charged to a Super Bowl title and Walker proposed doing away with state workers' unions. But the general election could ultimately tilt the ideological balance of the court for years to come.

MORGANTOWN, W.Va. -- The families of five people killed in a fiery 2007 crash are suing a convicted drunken driver and two bars that served him for negligence and wrongful death.

A lawsuit filed in Monongalia County Circuit Court names Brian Stone, Automatic Slim's Hot Spot and Novichenk's Tailgater's Pub 2 as defendants.

The complaint says bar employees knew or should have known Mr. Stone was already impaired when they served him the night of the crash. Police said his blood alcohol content was nearly three times the state's legal limit.

Calls to Novichenk's and the owner of the Hot Spot went unanswered today.

Blagojevich attorney: State should appoint lawyers

Illinois Gov. Rod Blagojevich's lawyer wants the state to appoint and pay for attorneys to represent the governor because Attorney General Lisa Madigan has a conflict of interest and can't do it.

Chicago attorney Ed Genson contends that it's Madigan's job to represent the governor in his impeachment and criminal cases. But he says she can't do it because she has asked the state Supreme Court to declare the governor unfit to serve.

Genson on Wednesday disclosed filings seeking court-appointed attorneys for his client. He also filed a motion asking the Illinois House to appoint and pay for lawyers to represent the governor as it considers an impeachment recommendation.

Madigan's office says it will respond soon to Genson's request.

Appeals court rejects DC missing pants case

An appeals court on Thursday turned down a request for a new trial from a former District of Columbia judge who sued his dry cleaners for $54 million over a lost pair of pants.

The D.C. Court of Appeals rejected the request from Roy L. Pearson to overturn a 2007 ruling that denied him damages. Pearson had argued that Custom Cleaners failed to live up to its promise of "Satisfaction Guaranteed."

Three appellate judges agreed Pearson failed to show the store's advertising amounted to fraud and said his argument defied logic.

Pearson can still ask the entire nine-judge appellate court to review the case or appeal to the U.S. Supreme Court.

Pearson did not immediately respond to an e-mail or telephone message seeking comment.

Jin Chung, the dry cleaner owner, said through his lawyer that his family is "very very happy" with the decision. The family said they hope Pearson won't take any further action.

The American Tort Reform Association lauded the court's move, saying the city's easily exploited consumer protection law should be reformed.

The case has taken its toll on both sides. The Chungs have sold the dry cleaning shop, citing a loss of revenue and the emotional strain of defending the lawsuit. Pearson lost his job when a D.C. commission voted not to reappoint him.

Special Message for Victims of Chatsworth Metrolink Disaster

On September 12, 2008, an unprecedented tragedy occurred in Chatsworth, California when Metrolink Train #111 struck a Union Pacific freight train which was traveling on the same tracks. Our hearts go out to the victims. But this tragedy should not have happened. It happened because of human error on the part of Metrolink employees. Unfortunately, as the lawyers of RKA know well, human error by railroad engineers is not at all unique as a cause of commuter rail disasters.

Jerome L. Ringler has greater experience in representing victims of commuter rail and freight train disasters than any other lawyer in the State of California, if not the country. He has served as lead counsel in every one of the largest commuter rail disasters which have occurred in Southern California in the past 10 years.

In the Placentia Commuter Rail Disaster of 2003, Mr. Ringler was appointed by the Court as lead counsel for all of the Plaintiffs. He was requested by all of the lawyers representing individuals injured or killed in that incident to try the first case. That case resulted in the largest verdict for Post Traumatic Stress Disorder ever rendered by a jury in the United States. That verdict, which was for $9 million, is detailed below in the multimedia section.

In the Burbank Commuter Rail Disaster, which also occurred in 2003, Mr. Ringler was again appointed by the Court to serve as lead counsel. In that capacity he was given the responsibility to try the entire liability (i.e., fault) case for all of the victims. In other words, every one of the dozens of lawyers who represented individual victims in that disaster trusted Mr. Ringler to try the liability phase for them, knowing that their clients would only recover if Mr. Ringler was successful. He was. In fact, Mr. Ringler not only obtained a favorable verdict for all of the plaintiffs, he obtained a $12 million verdict for his own client as well. This verdict was the largest in the State of California for a person with the type of injuries Mr. Ringler's client had suffered. This verdict is detailed below in the multimedia section.

Mr. Ringler is currently lead counsel for all plaintiffs in the Glendale Metrolink Derailment Disaster of 2005. This incident was, before September 12, 2008, the largest Metrolink disaster in history. Interestingly, in that case (which involves 11 deaths and dozens of serious injuries), Mr. Ringler has, against all odds, developed testimony proving that, even though a mentally-ill person placed a jeep across the tracks that the Metrolink train was traveling upon, human error on the part of the Metrolink engineer prevented him from stopping the train before hitting the jeep, which caused the train to derail. In other words, while the jeep certainly never should have been on the tracks, the Metrolink engineer would have been able to stop the train before ever striking the jeep had he only been paying proper attention. That case is scheduled to go to trial on June 8, 2009, with Mr. Ringler as lead counsel.

Jury selection resumes in O.J. Simpson trial

The judge in the O.J. Simpson armed robbery trial allowed jury selection to proceed Wednesday after looking into a report by two prospective jurors that they were contacted by somebody identifying himself as a member of the media.

Clark County District Court Judge Jackie Glass said she was confident neither person has been influenced by the contact.

It was unclear if the person actually represented a media outlet. Court officials were reviewing videotapes from the courthouse in an attempt to identify the man who contacted the two people after court adjourned Tuesday.

Court information officer Michael Sommermeyer said any media contact with jurors would be a violation of a court order and punishable with a contempt of court finding or confiscation of press credentials.

"The court and the judge are attempting to do everything in their power to empanel a jury that's as unbiased as humanly possible and not tainted by any outside influence," Sommermeyer said.
He said the two people refused to be interviewed and reported the alleged contact to the judge on Wednesday morning.

Prosecutors and defense lawyers are vying for an edge as they try to shape a jury that will decide whether Simpson and a buddy robbed two sports memorabilia dealers at gunpoint in a casino hotel room a year ago.

Twenty people have been dismissed after two days of questioning. No jurors have been seated. Twelve people have advanced through personal questioning by both sides to remain in consideration.

Texas appeals court stop scheduled execution

Attorneys for a killer who had been scheduled to die Wednesday say he should get a new trial because his trial judge and the prosecutor admitted having a secret sexual relationship that began years before his murder convictions.

Charles Dean Hood won a reprieve Tuesday, but not because of the alleged affair.
The Texas Court of Criminal Appeals said it will reconsider its previous dismissal of an appeal by Hood that challenged jury instructions. The court said developments in the law regarding jury nullification instructions made reconsidering its ruling prudent.

At the same time, the court dismissed claims by Hood's attorneys that he was denied a fair trial because of the alleged relationship between retired Judge Verla Sue Holland and former Collin County District Attorney Tom O'Connell. O'Connell and Holland gave depositions under a court order Hood's attorneys won on Monday.

Judge's ruling frees man convicted in 1984 murder

A man convicted in a 1984 gas-station killing has been freed from prison by a judge who ruled his capital murder trial was unconstitutionally flawed.

Darryl Burton, 46, was scheduled to appear Tuesday at a news conference in Kansas City along with the lawyers and supporters who fought for eight years to have his conviction and life sentence thrown out.

Burton was released from the Jefferson City Correctional Center on Friday, the same day prosecutors in St. Louis decided against trying him a second time.

Attorney Cheryl Pilate, of suburban Kansas City, said Monday night that she and co-counsel Charlie Rogers picked Burton up at the prison, along with a Columbia pastor who had befriended him.

"He had his first meal in Columbia with us," Pilate said. The group then went to St. Louis so that Burton could visit with family members, including "nieces and nephews he had never seen before. That was wonderful." He also has family in Kansas City and will live there, she said.
No physical evidence or suggested motive had ever tied Burton to the June 1984 shooting death of Donald Ball at an Amoco station in St. Louis. Instead, he was convicted solely on the testimony of two men who claimed to have witnessed the shooting.

But one of those witnesses, Claudex Simmons, lied during Burton's 1985 trial in St. Louis Circuit Court when he testified that his own criminal history consisted of just two convictions.

Simmons had actually been convicted of at least seven felonies and five misdemeanors — information that should have been disclosed to the jury, Cole County Circuit Judge Richard G. Callahan wrote in an Aug. 18 ruling accompanying a writ of habeas corpus.

Federal judge to appear in court on sex charges

U.S. District Judge Samuel Kent, usually in charge of dispensing justice, is to find himself on the other side of the bench as a defendant.

Kent was to make his first court appearance Wednesday after being indicted last week on federal sex crimes following a Department of Justice investigation. He is facing two counts of abusive sexual contact and one count of attempted aggravated sexual abuse.

If convicted of attempted aggravated sexual abuse, Kent could face up to life in prison and a fine of up to $250,000. Each of the two counts of abusive sexual contact carries a sentence of up to two years in prison and a fine of up to $250,000.

Kent's attorney, Dick DeGuerin, has said his client is innocent and will stay on the bench while he awaits trial.

Kent's former case manager, Cathy McBroom, accused the judge of physically harassing her in a sexual manner over a four-year period, starting in 2003. The final incident was in March 2007, when she said the judge pulled up her blouse and bra and tried to escalate contact until they were interrupted.

Her accusations were first investigated by the Judicial Council of the 5th U.S. Circuit Court of Appeals, which suspended Kent in September 2007 for four months with pay but didn't detail the allegations against him.

As part of the judicial council's punishment, Kent was transferred to the busy Houston federal courthouse, where McBroom was relocated after reporting her allegations. Kent had been the only U.S. District Court judge in Galveston, an island beach town 50 miles southeast of Houston.
Until his indictment, Kent was known for writing humorous rulings peppered with sarcastic scoldings of lawyers. Kent, a federal jurist in Galveston since President George H.W. Bush appointed him in 1990, has not presided over any high-profile cases.
